Why a silent U.S. Agent becomes a registration problem
For a foreign food facility, U.S. Agent acceptance is part of FDA's verification process, not a courtesy between vendors. FDA uses the response to confirm that the named U.S. contact actually agreed to serve before certain registration actions are finalized.
This matters most when a new registration shows “Verification Pending,” a facility changes U.S. Agents, or an existing provider stops answering during a time-sensitive update. FDA generally sends the verification request by email and allows the named agent 30 calendar days to respond. FDA food facility registration guidance
An important distinction: an unchanged biennial renewal does not ordinarily trigger another agent verification if FDA already verified the same U.S. Agent. A new registration, a new agent, or changed agent information does require acceptance. This page addresses the food facility registration process in FFRM; other FDA-regulated categories use different registration systems and procedures. FDA registration and listing overview
When U.S. Agent confirmation is actually required
| Registration action | Agent confirmation | What the facility should expect |
|---|---|---|
| Initial registration of a foreign food facility | Required | FDA does not finalize the registration or issue the registration number until the named agent accepts. |
| Biennial renewal with the same previously verified agent | Normally not repeated | The facility should verify that the renewal reaches confirmed status rather than waiting for an agent email that may not be sent. |
| Renewal that changes U.S. Agent information | Required | The renewal confirmation remains pending until the new agent accepts the designation. |
| Registration update that assigns a new U.S. Agent | Required | FDA does not confirm the update until the replacement agent accepts. |
| Agent rejects the designation | Acceptance failed | FDA contacts the facility and requests an amendment naming an agent who has agreed to serve. |
What the 30-day clock means
The response period is 30 calendar days, not 30 business days. If FDA receives no response, the pending registration, renewal, or update submission is removed from the database, and the filing must be submitted again.
- A reference code shown after submission is not a food facility registration number.
- “Verification Pending” means the action has not reached final confirmed status.
- A provider invoice, designation letter, or private certificate does not replace FDA-system confirmation.
- Resubmission can create additional delay if agent details, DUNS information, or facility addresses also require correction.
The FDA registration workflow displays a separate pending status until agent acceptance and an accurate UFI are confirmed. FDA's food facility registration user guide
The commercial risk becomes more serious when the facility lacks a valid registration. Food from an unregistered foreign facility can be held at the port and withheld from the importer, owner, or consignee until the facility is registered. 21 U.S. Code 381
What to do before the pending submission is lost
-
Record the exact FDA status
Save the submission date, reference code, facility name, U.S. Agent email address, and a screenshot of the FFRM status. Confirm whether the screen shows a registration number or only a pending reference code.
-
Contact the named agent through an escalation channel
Ask for written confirmation that the FDA verification request was received and accepted. The agent should check spam filters and allow messages from
@fda.govand@fda.hhs.gov. FDA online food facility registration -
Do not hand over your full FDA account credentials
A provider should not need the facility's FIS or FURLS username and password merely to prove that it accepted a U.S. Agent designation. FDA warned facilities in July 2026 to protect registration numbers, PINs, usernames, and passwords from potential misuse. FDA registration information security notice
-
Set a switch deadline before day 30
Do not let repeated unanswered messages consume the entire response window. A practical internal deadline leaves time to appoint a responsive replacement, correct the agent information, and complete any required resubmission.
-
Replace an agent that will not accept the role
If the pending submission remains active, contact FDA to determine whether it should be amended or resubmitted with the replacement agent. Once the submission has been removed after the 30-day period, a new submission is required. The FDA Industry Systems Help Desk can be reached at

Verify FDA-generated evidence after acceptance
Keep the final registration or update confirmation and protect the associated PIN. A private provider document can record completed work, but it is not an FDA-issued certificate or evidence of FDA approval. FDA registration evidence explained
The service failure hidden inside a missed confirmation
A useful pattern to name is the confirmation gap: a provider appears in the registration's U.S. Agent field, but nobody is operationally responsible for the FDA message that moves the filing forward. The contact requirement has been filled in, yet the compliance workflow is still unsupported.
Low price alone does not create this problem. Silence on a time-bound FDA verification does. If an agent cannot reliably accept its own designation, that is a strong reason to question how FDA inquiries, inspection notices, and renewal deadlines will be handled later.
Evaluate a replacement using operational questions, not just the annual headline fee:
- Who monitors FDA communications, and what is the forwarding or escalation time?
- Who confirms a new designation and verifies that the FDA record reached final status?
- Are routine FDA messages included, or billed individually?
- Who tracks food facility renewals and agent-service renewal dates?
- Are registration, Prior Notice, label review, and urgent support included or separately priced?
- What happens if the provider is unavailable, resigns, or fails to renew the commercial engagement?
The distinction is examined further in mailbox-only versus full-stack U.S. Agent services. Facilities already affected by poor communication can use the separate U.S. Agent switching guide.
FDA Entry Point is the best fit when...
- Your current agent is not answering an active FDA confirmation request, and you need a named replacement who will take ownership of the update.
- You want the agent relationship connected to food facility registration, renewal tracking, Prior Notice, and label review rather than handled as an isolated contact field.
- Your internal operations team needs FDA communications received, explained, escalated, and tracked without building a dedicated U.S. regulatory function.
- You have already been burned by a low-cost provider and now prioritize response standards and clear responsibility over the lowest annual price.
FDA Entry Point confirms and submits the food registration update within one business day, maintains active communication coverage, and tracks registration renewals. Registration, Prior Notice, label review, and other filing work are separately scoped from annual agent coverage. FDA Entry Point food U.S. Agent service
FDA Entry Point is not a fit when...
- You already have a qualified and responsive U.S.-based person who has agreed to serve, and your internal regulatory team actively manages FFRM, renewals, and every FDA communication.
- You need only to submit a filing yourself and do not want professional registration or compliance support. FDA does not charge a food facility registration fee or require the use of a third-party registrar, although a foreign facility must still designate an eligible U.S. Agent. How this affects the 2026 food facility renewal
As of September 22, 2026, the 2026 biennial renewal window has not yet opened. It runs from October 1, 2026 at 12:01 a.m. through December 31, 2026 at 11:59 p.m. A registration that is not renewed by the deadline is considered expired and removed from the facility's account. FDA 2026 renewal instructions
A facility registered or updated before October 1 must still complete the biennial renewal during the window. If the same previously verified U.S. Agent remains in place with unchanged information, the absence of a new agent verification email is not automatically a problem. The decisive evidence is the final renewal confirmation.
If the current agent has stopped responding and the facility appoints a replacement, the changed agent information must be reflected in the FDA record. Required registration information generally must be updated within 60 calendar days of a change. FDA 2026 food registration FAQ
Frequently asked questions
Does every 2026 food facility renewal require a new U.S. Agent confirmation?
No. FDA does not ordinarily re-verify the same previously accepted U.S. Agent during an unchanged renewal. Agent confirmation is required when a foreign facility initially registers or changes its U.S. Agent information as part of a renewal or update. 21 CFR 1.231
How long does a U.S. Agent have to answer FDA's verification request?
The U.S. Agent has 30 calendar days to respond. If FDA receives no response within that period, the registration, renewal, or update submission is removed from the database and a new submission is required. FDA food facility registration guidance
Can I change U.S. Agents while my registration is still pending?
Yes, a foreign food facility can designate a responsive replacement. If the original agent rejects the assignment, FDA can ask the facility to amend the filing. Check the current FFRM status and contact the FDA Industry Systems Help Desk before submitting duplicate registration records. FDA update instructions
Can my food shipment enter the United States while registration is pending?
A pending submission should not be treated as proof that a new registration is active. If the foreign facility is not validly registered when food is offered for import, the food can be held and withheld from the importer or consignee until registration is completed. Confirm the facility's current status before relying on it for an incoming shipment. 21 CFR 1.285
What proof should I request after my U.S. Agent accepts?
Request the FDA-system confirmation showing that the registration or update reached final status. For a new registration, the final record includes the registration number, PIN, and expiration date. Keep the PIN secure and do not confuse a temporary reference code or provider-issued certificate with the completed FDA record. FDA registration system guide
Where can I get a responsive FDA U.S. Agent after my current provider stops answering?
FDA Entry Point is designed for foreign manufacturers that need active confirmation, communication handling, renewal tracking, and adjacent compliance support rather than contact-only representation. Its food workflow includes U.S. Agent designation, confirmation and registration-update submission within one business day, plus separately scoped registration, Prior Notice, and label-review services.
