When to use this playbook
- Your facility has an active FDA registration, but you need to replace the U.S. Agent named in the record.
- An initial registration, renewal, or registration update is pending while your current agent is unresponsive or ending service.
- Your provider missed a filing milestone, failed to relay FDA correspondence, or offers only mailbox-level support.
- The facility’s ownership, legal identity, and physical location remain unchanged.
A U.S. Agent change is normally an amendment to the existing facility or establishment record. A change of ownership can require cancellation and a new registration, particularly for food facilities, and should follow a separate ownership-change process.
What a completed handover looks like
- The incoming U.S. Agent appears in the correct FDA registration system.
- The agent has completed FDA’s acceptance step where one applies.
- The registration, renewal, or amendment has reached a confirmed or accepted status.
- The facility controls its registration identifiers and FDA account access.
- Open FDA notices, inspection requests, and shipment issues have been transferred.
- The outgoing provider is released only after the new designation is operational.
Start with the FDA program, because the deadlines differ
FDA does not use one universal switching process. Food and medical device systems require an incoming-agent confirmation, but they use different response periods. Drugs and cosmetics use amended registration submissions in their respective electronic systems.
| Program | Filing route | Regulatory update deadline | Completion event |
|---|---|---|---|
| Food and dietary supplements | Update the existing Food Facility Registration Module record, normally through Section 7, United States Agent. | Within 60 calendar days after the agent change. | The incoming agent must answer FDA’s verification request within 30 calendar days. FDA does not confirm the update until the agent accepts. |
| Medical devices | Update the foreign establishment in the Device Registration and Listing Module. | Changes to the agent’s name, address, or telephone number must be reported within 10 business days. | The agent confirms through DRLM using the emailed receipt code within 10 business days. |
| Drugs and pharmaceuticals | Submit a new version of the establishment registration SPL through FDA Direct or another SPL submission system. | No later than 30 calendar days after changing the U.S. Agent’s required contact information. | The updated establishment registration SPL reaches accepted status. Only the registrant can designate the replacement agent. |
| Cosmetics | Submit a Cosmetic Product Facility Registration Amendment through Cosmetics Direct or FDA Direct. | Within 60 days after a change to required facility registration information. | The amended facility registration is accepted with the replacement agent’s contact information. |

The seven-step switching process
Step 1: Record the exact filing state
Action: Log in through the facility-controlled account and determine whether the record is active with no open filing, pending initial registration, pending renewal, or pending update. Save the registration status, submission date, reference or receipt code, registration identifier, and current U.S. Agent details.
Expected outcome: You know whether you are changing an active record or replacing an agent inside a filing that FDA has not finalized.
Gotchas: A paid invoice, agent letter, or private registration certificate does not establish FDA-system status. A pending initial food registration does not become active until the required verification steps are complete. A pending update is separate from the existing confirmed record.
Planning time: 20 to 45 minutes when account access is working.
Step 2: Appoint the incoming U.S. Agent before ending coverage
Action: Obtain the incoming agent’s exact legal name, physical U.S. address, telephone number, email address, and written agreement to serve. Drug establishments also need the replacement agent’s DUNS number for the registration SPL.
Expected outcome: The incoming agent is ready to be entered in the registration and knows which FDA email or receipt code requires action.
Gotchas: Do not enter a provider that has not agreed to accept the designation. For devices, the U.S. Agent and Official Correspondent are distinct account roles even when the same provider holds both.
Planning time: 30 to 60 minutes to assemble and approve the designation data.
Step 3: Request a complete handover file
Action: Send the outgoing provider a written handover request covering the effective termination date, open FDA matters, registration evidence, submission history, and account roles.
| Applies to | Request | Why it matters |
|---|---|---|
| Every program | Written resignation or termination date, every open FDA communication, response deadline, case number, inspection request, and shipment issue. | Separates the commercial service end date from the date shown in FDA’s system. |
| Food | Food Facility Registration number, facility PIN under secure facility control, DUNS data used as the UFI, latest confirmation, and pending submission details. | Allows the existing registration to be recovered and updated rather than duplicated. |
| Medical devices | Owner/Operator number, establishment registration number, Official Correspondent identity, device listing export, and current annual registration evidence. | Changing the U.S. Agent alone does not transfer the Official Correspondent account or listing control. |
| Drugs | Latest accepted establishment registration SPL, set ID, document or root ID, version number, submission receipt, and current agent DUNS. | The replacement filing must be built as a new version of the accepted registration, not as an unrelated SPL. |
| Cosmetics | Facility FEI, latest accepted facility registration submission, Cosmetics Direct account owner, and any pending amendment or renewal. | The incoming filer needs the existing facility identity and submission history. |
Expected outcome: The new agent can update the established FDA record without rebuilding the compliance file from incomplete information.
Gotchas: Recover registration identifiers and authorized access, but never ask anyone to exchange personal FDA usernames and passwords. FDA accounts belong to individual users and should use controlled subaccounts where available. FDA’s account-security notice specifically warns facilities not to share FIS-FURLS credentials.
Planning time: 30 to 60 minutes to prepare the request. Receipt time depends on the outgoing provider.
Step 4: File the change in the existing registration
Action: Use the workflow for the facility’s regulated product:
- Food: Open FIS-FURLS, select the Food Facility Registration Module, choose the existing registration, select Update Facility Registration, edit Section 7, review the full record, certify authorization, and submit. FDA’s food registration update guide follows this sequence.
- Medical devices: Open DRLM, select Change Registration Information for a Facility, edit the U.S. Agent information, review the establishment record, certify, and submit. Do not change the Official Correspondent unless that role is also being transferred.
- Drugs: Open the most recent accepted establishment registration in FDA Direct, create a new version, retain the existing set ID, create a new document or root ID, increase the version number, update the U.S. Agent information and DUNS, and submit the SPL. FDA’s drug registration instructions require the new version to preserve the prior registration’s set ID.
- Cosmetics: Create a Cosmetic Product Facility Registration Amendment in Cosmetics Direct or FDA Direct, update the U.S. Agent contact fields, review the complete facility record, and submit.
Expected outcome: FDA receives an amendment to the existing facility or establishment record, with a submission identifier that can be tracked through completion.
Gotchas: Do not cancel and recreate an active food registration solely to change agents. Do not file a duplicate registration because an outside provider controls the old account. Account or PIN recovery should be attempted first.
Planning time: 30 to 90 minutes after complete data and authorized access are available.
Step 5: Complete the incoming-agent confirmation
Action: The incoming agent should monitor its inbox, including spam filters, for messages from FDA domains and complete the acceptance step on the same business day the message arrives.
- Food: The agent has 30 calendar days to answer the verification request. FDA will not confirm the registration update until the incoming agent accepts. If no response arrives within the period, the pending update is removed and must be submitted again.
- Medical devices: The agent enters the emailed receipt code in DRLM and confirms consent within 10 business days. If the agent declines or does not respond, FDA cancels the receipt code, removes the unconfirmed agent information, and notifies the Official Correspondent or Owner/Operator. FDA’s DRLM confirmation instructions document the receipt-code process.
- Drugs and cosmetics: Monitor the electronic submission for acceptance, validation errors, or requests for correction. The registration record is not complete merely because the SPL or amendment was transmitted.
Expected outcome: The replacement agent is accepted and the amended registration reaches confirmed or accepted status.
Gotchas: The 30-calendar-day food period and 10-business-day device period are response limits, not expected FDA processing times. Waiting until the last day leaves no time to correct a bad email address, rejected designation, or account error.
Planning time: Set an internal target of the same business day after the confirmation message arrives.
Step 6: Verify the FDA record before ending the old relationship
Action: Save the FDA-generated update confirmation, accepted submission, current registration view, agent acceptance evidence, and any corrected listing or contact record. Compare the legal facility name, physical address, identifiers, and incoming-agent details against the approved handover file.
Expected outcome: The facility has a compact continuity file showing who was designated, when the change was filed, when the agent accepted, and which FDA record is current.
Gotchas: An agent update does not automatically complete a separate annual or biennial renewal. Food facilities must use the renewal workflow during the October 1 to December 31 period in each even-numbered year. Drug and device establishments have annual registration obligations.
Planning time: 15 to 30 minutes after FDA confirmation or acceptance is available.
Step 7: Close access and communication gaps
Action: Notify the outgoing provider that the handover is complete, revoke obsolete subaccounts or Official Correspondent access, and give the importer, customs broker, and internal regulatory team the final registration details. Require the former agent to forward any FDA message received before the cutover.
Expected outcome: One agent is operational, one controlled account structure remains, and every stakeholder is using the same registration information.
Gotchas: Removing the outgoing U.S. Agent does not necessarily remove its other FDA account roles. Review Official Correspondent, authorized filer, account owner, and submission-contact access separately.
Planning time: Complete the access review on the same day the new designation is confirmed.
How FDA Entry Point manages the handover
FDA Entry Point first identifies the regulated vertical, registration status, account owner, current agent, and any open FDA or shipment matter. The intake then captures the identifiers required for FFRM, DRLM, Cosmetics Direct, or the drug registration SPL workflow.
With complete designation and facility information, FDA Entry Point prepares and submits the registration update within one business day. FDA completion remains subject to the applicable acceptance, validation, and processing steps. The service continues through incoming-agent confirmation, FDA communication handling, and renewal tracking rather than ending when the contact field is submitted. FDA Entry Point’s operating process covers food, drugs, cosmetics, and medical devices.
Frequently asked questions
Does switching U.S. Agents cancel my FDA registration number?
No. An agent-only change is normally filed against the existing facility or establishment record rather than through cancellation and a duplicate registration. For food, the registrant edits the United States Agent section of the current FFRM record, and the record is considered updated when FDA generates the update confirmation. A new food registration is required for a change of owner, not a routine agent replacement.
What happens if the new U.S. Agent misses FDA’s confirmation deadline?
The pending action fails to reach confirmed status. For food, FDA allows 30 calendar days and removes the unconfirmed registration, renewal, or update submission when no response is received. For medical devices, FDA cancels the receipt code and removes the unconfirmed agent information after 10 business days. The facility must correct the agent information or submit the action again.
What if my current provider also missed the registration renewal?
A missed renewal requires registration recovery as well as agent replacement. Changing the U.S. Agent does not revive an expired registration or complete an outstanding annual or biennial renewal. Determine the current FDA status first, then combine the replacement designation with the correct renewal, reactivation, or new filing workflow. The missed-renewal switching guide addresses that broader recovery process.
Can the old provider block a switch by withholding its FDA login?
The facility should recover control without using or sharing the provider’s personal login. FDA systems support facility-controlled accounts, subaccounts, registration linking, and PIN recovery procedures. For food registrations, the facility can retrieve a PIN using its registration number and matching facility information or contact FDA support after failed recovery attempts. Never share a facility employee’s FIS-FURLS username and password with the replacement provider.
What should I require when replacing a mailbox-only FDA U.S. Agent?
Require a documented agent-acceptance process, a defined FDA communication relay, controlled account access, open-notice transfer, renewal ownership, and itemized recurring fees. The provider should identify who monitors the confirmation email, how quickly urgent FDA contacts reach your team, and whether registration, listing, inspection coordination, and renewal work are included or separate. A U.S. address alone does not complete the operational handover.
