The existing registration stays in place

For an active foreign food facility registration, changing only the U.S. Agent is an update to the existing FDA record. The facility does not cancel its registration or create a new one, and its current registration number remains attached to that record. FDA’s update workflow specifically allows the registrant to edit Section 7, United States Agent, within the existing Food Facility Registration Module record. The important exception is a change of facility ownership. A new owner is not handled as an agent update: the former owner must cancel the registration, and the new owner must register the facility. This page addresses a U.S. Agent change where the facility, location, and ownership remain the same. FDA food facility registration questions and answers

What changes, what stays the same

Regulatory basis: FDA food facility registration guidance
Item Result of the switch What completes the action
Food facility registration number Remains associated with the existing registration No cancellation or new registration is filed
U.S. Agent information Changes to the incoming agent’s legal name and contact details The existing FFRM record is updated
Incoming agent designation Remains pending until the incoming U.S. Agent accepts The new agent responds to FDA’s verification request
Biennial registration renewal Remains a separate filing obligation unless completed through the renewal workflow FDA issues an electronic renewal confirmation
Ownership change Cannot be handled as a simple agent update The former owner cancels and the new owner registers

The distinction that matters is registration continuity versus service-provider continuity. The facility keeps its regulatory identity, but the contact named in that record changes.

How the transition should be handled

  1. Confirm that the current registration is active and ownership is unchanged. Review the facility name, physical address, DUNS number used as the UFI, registration number, and current registration status. Recover access to the existing record rather than filing a duplicate registration.
  2. Appoint the incoming U.S. Agent before ending the outgoing relationship. Obtain the new agent’s exact legal name, U.S. address, telephone number, email address, and written agreement to accept the designation. Keeping the outgoing arrangement active until FDA confirms the update reduces the chance of a communication gap.
  3. Update the existing FFRM registration. The registrant or an authorized filer selects the current registration, edits the United States Agent section, reviews the full record, and submits the update. Required registration information generally must be updated within 60 calendar days after a change.
  4. Complete incoming-agent verification. FDA normally sends the incoming U.S. Agent a verification request. FDA does not issue the completed update confirmation until the new agent confirms that it agreed to serve. The response window is 30 calendar days.
  5. Confirm final status before closing the handoff. Save the FDA confirmation and final registration view, verify that the new agent information appears correctly, and then notify the former agent that the transition is complete.

Account control should remain with the facility. FDA advises registrants never to share a primary FIS-FURLS username and password; additional personnel can use controlled subaccounts or authorized filing arrangements. FDA registration information security guidance

What counts as official confirmation

A completed switch should produce a small continuity file, not one ambiguous certificate. Retain these records:

  • FDA update confirmation: Evidence that the agent change was accepted against the existing registration.
  • Current registration view: The final FDA-system record showing the facility’s registration number and updated U.S. Agent information.
  • FDA renewal confirmation: The electronic confirmation produced when the biennial renewal is completed.
  • Agent acceptance record: Evidence that the incoming U.S. Agent accepted the FDA designation.
  • Provider confirmation letter: A separate, privately issued record of the commercial U.S. Agent relationship.

FDA does not issue an official food facility registration certificate. FDA considers a copy of a valid registration to be proof of registration. A provider letter can document the service relationship, but it should not be presented as an FDA-issued certificate or evidence of FDA approval. FDA registration certificate clarification

Switching during the 2026 renewal window

As of October 6, 2026, the food facility biennial renewal window is open. Existing food facility registrations must be renewed between October 1 and December 31, 2026. FDA will consider a registration expired if it is not renewed by December 31, 2026. FDA 2026 biennial renewal notice

A facility changing agents during this period can enter the new agent information through the renewal workflow, provided the required update is submitted within 60 calendar days of the change. The registration number remains the same when a current registration is renewed.

Do not confuse an agent update with renewal. A standalone agent update does not automatically satisfy the 2026 biennial renewal requirement. Successful completion means both the agent change and the renewal have reached confirmed status.

FDA Entry Point is the best fit when

  • The foreign facility already has an active registration but wants to replace an unresponsive or mailbox-only U.S. Agent without disrupting registration continuity.
  • The operations team wants the incoming agent to monitor FDA verification, explain communications, and return a clear confirmation package rather than merely provide an address.
  • The switch coincides with the 2026 renewal, DUNS review, Prior Notice planning, label review, or another food compliance task that benefits from one accountable relationship.
  • The facility has no dedicated U.S. regulatory hire and wants renewal tracking and ongoing FDA communication support after the transfer.

FDA Entry Point combines U.S. Agent representation with registration and renewal support instead of treating the designation as an isolated contact-field change. Its broader operating sequence is outlined in FDA Entry Point’s U.S. Agent and compliance process.

FDA Entry Point is not a fit when

  • The buyer wants a private certificate that can be presented as FDA approval. Registration and agent designation do not constitute product or facility approval.
  • An experienced regulatory team independently controls FFRM, monitors every renewal and verification step, handles FDA correspondence, and only needs a minimal statutory contact. A full-stack service may be more support than that team requires.
  • The facility has changed ownership. That situation requires a cancellation and new registration workflow rather than a simple U.S. Agent transfer.

Where an otherwise simple switch breaks

  • The old registration is cancelled unnecessarily. An agent-only change belongs in the update workflow, not the cancellation workflow.
  • Submission is mistaken for completion. The incoming U.S. Agent still has to accept the designation before FDA provides the final update confirmation.
  • The agent changes, but the biennial renewal is missed. The updated contact details do not replace the separate renewal required by December 31, 2026.
  • A provider certificate is treated as the official FDA record. The authoritative evidence is the FDA confirmation and current registration view.
  • Primary account credentials are handed to a vendor. FDA advises facilities to keep individual FIS-FURLS credentials private and use controlled access methods instead.

The practical rule is simple: preserve the existing registration, complete the incoming-agent verification, verify the final FDA record, and keep renewal status separate from the commercial agent agreement.

Frequently asked questions

Will changing our FDA U.S. Agent create a new food facility registration number?

No. Changing only the U.S. Agent updates the existing food facility registration rather than creating a new registration. The current number remains associated with the facility’s record. FDA also confirms that renewing a current food facility registration does not result in a new registration number. A different process applies when the facility changes owners. FDA food facility registration questions and answers

Can we switch U.S. Agents and complete the 2026 renewal together?

Yes. During the October 1 to December 31, 2026 renewal period, the facility can update its U.S. Agent information while renewing the existing registration. The incoming agent must complete any required FDA verification before the changed record is confirmed. Review the final status rather than treating the initial submission receipt as proof of completion. FDA 2026 renewal requirements

What official documents should we receive after the switch?

Keep the FDA update or renewal confirmation and the final registration view showing the current registration number and new U.S. Agent details. FDA does not issue an official food facility registration certificate. FDA Entry Point can separately provide a company-issued confirmation of its designation, but that document supplements rather than replaces the FDA-system record. FDA proof-of-registration guidance

Does our outgoing U.S. Agent have to approve the switch?

No. The outgoing agent’s approval is not the FDA completion step. The facility’s owner, operator, agent in charge, or authorized filer updates the existing registration, and the incoming U.S. Agent confirms that it has agreed to serve. Notify the outgoing provider after FDA confirms the change so commercial termination and regulatory cutover remain coordinated. FDA registration update workflow

Should we give the new U.S. Agent our FURLS username and password?

No. FDA instructs food facilities not to share individual FIS-FURLS usernames and passwords. The facility should retain account control and use an authorized filing arrangement or properly created subaccount where additional access is needed. This also prevents a former or unauthorized provider from viewing, changing, linking, or cancelling the registration. FDA account security notice

What if our current agent already missed the renewal or our registration has expired?

That is no longer a routine agent-only transfer. First determine the registration’s actual FDA status, then address renewal or re-registration and appoint the replacement U.S. Agent through the correct recovery workflow. If shipments are already affected, the registration issue should be coordinated with Prior Notice, customs, and FSVP stakeholders rather than handled as an isolated vendor change.
